Commercial Terms

1. Seller and acceptance

PolyBanner is a registered business name of Cristian Polycarpou, a sole trader in Australia. PolyBanner™ software and licences are supplied by Cristian Polycarpou trading as PolyBanner (“we”, “us” or “our”). By completing a paid PolyBanner™ purchase, you agree to these Commercial Terms and acknowledge the Privacy Notice. If you are purchasing for a business, you confirm that you are authorised to accept these terms for that business.

2. Commercial licence

A paid licence is a limited, non-exclusive and non-transferable right to use the eligible PolyBanner™ software for your own or your studio’s internal business work on up to two activated devices at a time. The licence, licence key, installer and private download links must not be sold, sublicensed, shared publicly, redistributed or used to provide access to an unrelated third party. You must not interfere with the licensing service or reverse engineer the software except to the extent the law permits that right despite these terms.

3. Annual licence

An Annual licence is charged in advance for 12 months and automatically renews for another 12 months using the payment method held by Stripe unless it is cancelled before the next renewal. It includes use of PolyBanner™ and eligible updates while the Annual licence remains active.

You may request cancellation at any time by emailing polybannersupport@gmail.com. Cancellation stops the next renewal and normally takes effect at the end of the current paid period, so access continues until that date. We will confirm when the cancellation has been processed. This does not limit any cancellation or remedy required by law.

4. Lifetime licence

A Lifetime licence is a one-time payment with no recurring licence fee. It lets you keep using your last eligible PolyBanner™ version for as long as that version remains compatible with your system. It includes eligible updates released during the first 12 months after purchase. Optional update coverage and future major-version upgrades may be offered separately.

5. Annual to Lifetime upgrades

While an Annual term is active, an eligible Lifetime upgrade credits the unused value of the current Annual term. The credit is calculated from the time remaining in that current paid period and does not accumulate or stack previous Annual payments.

For a Standard Annual licence, the eligible Lifetime price is capped at A$179 from 30 days before the current Annual term ends until 30 days after it expires, when that produces a lower price than the unused-period credit. After that window, the normal eligible Lifetime price applies. A lower founder or other recorded pricing cohort is not increased by this cap.

Upgrade eligibility and price are calculated by the PolyBanner™ service. The secure private offer shown before Stripe Checkout displays the amount that applies. Completing a Lifetime upgrade ends the linked Annual subscription without a further prorated refund or credit.

6. Prices, payment and delivery

Prices are displayed in Australian dollars. The total payable is shown in Stripe Checkout before you purchase. Stripe processes payment details; PolyBanner™ does not receive your full card number. After successful payment verification, the licence details and available private download are shown on the confirmation page and sent to the purchase email where delivery is configured.

You are responsible for entering an email address you control and for keeping licence keys and private download links confidential. Contact support if delivery does not arrive or the details are incorrect.

7. Requirements and safe use

PolyBanner™ is a Photoshop UXP plugin and requires a compatible version of Adobe Photoshop and an internet connection when Photoshop starts to verify the licence. Compatibility details published on the website at the time of purchase form part of the product description. Keep backups of important documents and review generated output before production use. You remain responsible for the content you process and for complying with client confidentiality and other legal obligations.

8. Product problems, refunds and consumer rights

If PolyBanner™ does not work as described, contact support and we will assess the problem and work with you on an appropriate solution. Depending on the circumstances, that may include troubleshooting, repair, replacement, re-supply, cancellation or a refund.

We do not generally provide refunds merely because you change your mind. This change-of-mind position does not restrict your rights where the product or service fails to meet a consumer guarantee. Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

9. Suspension or termination

PolyBanner™ may suspend or end a licence for fraud, unlawful use, public sharing or redistribution, interference with the service, or another material breach of these terms. Where reasonably possible, we will provide notice and an opportunity to resolve the issue. Suspension or termination does not remove rights or remedies that have already accrued or cannot lawfully be excluded.

10. Changes to these terms

The version presented when you purchase governs that purchase. Updated terms may apply to future purchases or renewals. We will give reasonable notice of a material change that affects an existing Annual licence and will not retrospectively remove a paid entitlement.
